Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BrokerHub platform, including all associated websites, applications, tools, and services (collectively, the "Service"), operated by BrokerHub ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age and a licensed real estate professional in your jurisdiction to use the Service. By registering, you represent and warrant that you meet these requirements.

2. Account Registration

You agree to provide accurate, current, and complete information during the onboarding process and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may use the Service solely for lawful purposes related to your real estate business. You agree not to:

You retain ownership of all content you upload to the Service, including but not limited to photos, logos, documents, and listing data ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process Your Content solely to provide and improve the Service.

You represent and warrant that you have the right to upload and use all content you submit, including any OREA forms and listing photographs.

5. Fees and Payment

All fees are quoted in United States dollars (USD). By subscribing to the Service, you agree to pay all applicable fees as described on our pricing page or in a separate agreement.

5.1 Setup Fee

A one-time setup fee is charged at the time of purchase. The setup fee is non-refundable once your onboarding form has been submitted, as this initiates the account configuration process. If you wish to cancel before submitting your onboarding form, you may request a refund of the setup fee by contacting info@thebrokerhub.io.

5.2 Payment Plans

If you select a payment plan, an initial deposit is collected at checkout. The remaining balance is divided into monthly installments (3, 4, or 5 months as selected). Interest may apply to extended payment plans as disclosed at checkout. All payment plan installments are non-refundable once your onboarding form has been submitted. If you wish to cancel before submitting your onboarding form, you may request a refund of your deposit by contacting info@thebrokerhub.io. By selecting a payment plan, you are committing to the full setup fee amount.

Cancelling your monthly subscription does not cancel or reduce your remaining payment plan installments. The setup fee is a separate obligation from the monthly subscription. Payment plan installments will continue on schedule until the full setup fee is paid, regardless of whether your monthly subscription is active.

5.3 Monthly Subscription

Your monthly subscription fee is billed automatically on the same date each month. Monthly fees are non-refundable. To cancel your subscription, you must provide 30 days' written notice to info@thebrokerhub.io. Your access will remain active until the end of the current billing period after notice is received.

5.4 Failed Payments

If a payment fails, we will attempt to collect the payment automatically. If payment continues to fail after multiple retry attempts, your subscription may be suspended or cancelled. You are responsible for maintaining a valid payment method on file.

5.5 Setup Guarantee

We guarantee your account will be fully configured and live within 48 hours of receiving your completed onboarding form. If we fail to meet this timeline, your first month's subscription fee will be waived.

5.6 Price Changes

We reserve the right to change our pricing with 30 days' written notice. Price changes do not apply to active payment plan installments.

6. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by BrokerHub and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited right to use it in accordance with these Terms.

7. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., GoHighLevel, IDX providers, Zapier). We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party integrations is subject to their respective terms and policies.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, BrokerHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BrokerHub, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. You may cancel your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (e.g., indemnification, limitation of liability) will remain in effect.

13. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
